Manged 24/7 with Antivirus for your computers and Servers.   

Terms and Conditions: For Managed 24/7 with Antivirus services This is a monitoring service with managed antvirus we will monitor and remove viruses that are detected for free. Any manual remote or onsite repair work is chargable! All other services and repairs will be provided at normal fees.

1) This document is a Legal Contract. We suggest you obtain a separate legal opinion should you not understand any part of it.

2) Direct Debit or other payment options chosen of the agreed value will be made from your bank account or due the first week of each month.

3) I understand I will be charged for additional services automatically as  they be come due. (ie. on-site service, initial clean up of infections fee of £45 per hour if needed) Any approved services you request.

4) Your Bank statement will show charges from “Go Cardless – Cartcom”.

5) You can cancel the monitoring service at any time in writing via snail mail or email..

6) Cancellation results in the immediate termination of the monitoring and Managed 24/7 with antivirus service.

7) There is no cancellation fee unless you are a Unlimited Remote Repair Customer.

8) No refunds are made for services paid in advance.

9) This is a monitoring service with managed antivirus.

10) To monitor your computers and perform remote assistance two small programs must be installed on each machine.

a. You must not alter or reverse engineer or attempt to hack this software in any way.

b. The software can only be installed on the agreed machines and in the agreed quantities.

c. You acknowledge that this software will periodically perform updates for the purposes of enhanced performance, bug fixes and added functionality.

d. Upon termination of your service you agree to uninstall this software from all applicable machines.

e. You acknowledge that you do not own this software; it is merely on loan for the purposes and duration of this agreement.

f. You acknowledge that the computers being monitored must be switched on at least periodically.

g. You acknowledge that the computers must have access to the internet through which they’ll communicate with the host monitoring system.

12) Remote assistance may require somebody on your site to perform certain tasks and grant certain permissions.

13) Data gathered via this tool is completely confidential and shall only be used for the purposes of providing services to you and your organization within the terms of this agreement.

14) You understand that from time to time we will contact you via email, SMS and/or telephone to advise you of issues we perceive as requiring your attention.

15) You understand that this monitoring system…

a. May periodically send you automated reports on the status of your computer/s.

b. Has been tuned to suit your individual needs at the time of installation and may not necessarily be monitoring everything within its capabilities.

c. May have additional functionality turned on and/or enhanced during the time of this agreement.

d. Cannot detect or prevent all problems, failures or issues

e. Cannot rectify or in any way enhance or compensate for slow, failing, old or otherwise faulty hardware.

f. Is NOT a substitute for a properly tested backup system.   “Add Cartcom’s  Backup solution to your account and have your backup solution manged by us as well.

16) You understand that managed antivirus…

a. Is not a silver bullet

b. It moves the management of anti-malware handling to us!

c. Is a man made system and the bad guys game is to get around these products no matter who makes them.

d. Is no substitute for a proper backup system.

e. Careful browsing and email discipline is and always will be a necessary part of web use irrespective of the antimalware product you use.

f. New viruses and malware are being created all the time. “Risky browsing” and other risky behaviors (such as, but not limited to, opening attachments to emails from strangers) will at some stage result in your system being compromised by malicious software no matter what “protective” software you are running.

g. If you must take risks then it is advised that a sacrificial and non-critical machine be employed for that purpose.

17) We are not liable for any damages or loss whatsoever. Your hardware, software and site management are entirely your responsibility.

18) We reserve the right to cancel or amend this service for any reason whatsoever.

19) You will be notified in writing of any changes affecting your service or this agreement.

20) We reserve the right to change or amend the terms of this agreement without prior notice.

21) Any changes of your details contained in this application must be notified in writing and with the revised agreement signed and returned within 14 days.

22) You agree that this contract will be deemed to be made in United Kingdom and agree to submit to the jurisdiction of the appropriate courts nominated by that state.

23) Privacy Act

a. We are entitled to undertake all and any necessary enquiries, investigations, and assessments to ensure the accuracy of the information provided. Further, that such information, as verified, may be used by Cartcom, and any authorized agent, employee or subcontractor engaged by the Cartcom for the purpose ofreviewing, vetting, monitoring, and if necessary, actioning the use and performance in the operation of the service, including recovery of any outstanding Account balance.

b. Your information will not be passed on or sold for the purposes of marketing or related activities.

24) You will pay to “Cartcom” the costs and expenses incurred by them or their solicitors and/or legal advisors, in respect of anything instituted or being considered against the customer for debt recovery or related.

Unlimited Remote Repair Service

Unlimited Remote or Onsite repair service is provided to you on the basis of fair usage.  If Cartcom believes that the amount of repairs you are requesting are above average  then Cartcom are either allowed to increase your monthly service charge or cancel your account within immediate affect.  If we cancel your account Cartcom will bill you for the work carried out at our standard rates, minus your payments made for the Unlimited service.  Cartcom must do this to ensure that customers are fairly allocated services.

You also agree, if you cancel your unlimited labour plan before a full 12 months worth of payments are made, Cartcom have the right to charge for all labour at our standard rates, minus the payments you have made.  Cartcom do this to eliminate abusers of our unlimited service. Each year you enter into another agreement automatically. So for example you have service with us for 14 months and you cancel. Cartcom charge for the 2 months worth of work you used minus the 2 months payments.

If an order is submitted on line a third party company provides the payment gateway, Cartcom do not have access to your credit card details and do not store them physically or on our servers. Upon accepting a telephone order, your details are confirmed and your credit card details are destroyed immediately. We do not store any credit or debit/payment information on our website or physically at our office address.

Your Agreement – Important

Every time you pay or receive an invoice from Cartcom, you are also agreeing to these terms and conditions. So when you pay, you automatically agree to our terms and conditions.

Cancellation of Services.

To cancel any of Cartcom's you MUST first fill out our cancellation form found here: www.cartcom.co.uk/cs.html
Once we receive this form we will contact you with confirmation of cancellation.  You agree that if this form is NOT completed, Cartcom will carry on providing services and bill the appropriate fee.
