Employment Counsel

Full time • San Francisco, CA • Hybrid

Flynn Group (together with its subsidiaries Apple American Group, Bell American Group, Pan American Group, RB American Group, Hut American Group, Wend American Group, and Flynn Fitness Group) seeks an exceptional Employment Counsel to join its industry-recognized legal team. In this position, you will litigate, counsel, and support compliance efforts for the world’s largest franchise operator, with more than 2,600 restaurants and gyms, and over 75,000 employees across the U.S. and Australia. The position may be based in any of our Support Centers located in San Francisco, CA; Cleveland, OH; or Overland Park, KS.

Responsibilities

  • Under the supervision and guidance of Flynn’s senior in-house employment litigators, support the handling of litigation and arbitration matters from start to finish, as well as oversee and coordinate outside counsel litigation efforts. You will have the opportunity to interview witnesses, prepare for, take, and defend depositions, handle written discovery and motion practice, engage in pre-trial dispute resolution, and participate in arbitration and/or trial.
  • Provide advice and counseling across a broad spectrum of nationwide employment issues, including wage and hour, payroll, benefits, hiring, performance management, internal investigations, leaves of absence, discipline, terminations, employee classification, and employee privacy.
  • Respond to agency charges, government audits, and demand letters.
  • Collaborate with Legal, HR, Payroll, Operations, Risk, and Training on employment-related compliance matters, including conducting wage and hour compliance audits, identifying additional areas of employment-related compliance opportunities, advising on preventative and corrective action plans, updating internal business clients on new laws and legal trends, and supporting training initiatives.
  • Support updating/revising company policies per changes in external laws and regulations.
  • Monitor federal, state, and local legislation, regulations, and case law on employment-related matters pertinent to the company; communicate updates and recommendations as needed.
  • Occasional travel involved.

Requirements

  • 5-7 years of employment law experience.
  • Juris Doctor from an accredited law school; must have bar admission in good standing. California Bar admission or deep knowledge of California law strongly preferred.
  • Experience in various stages of employment litigation, as well as knowledge of federal and state employment laws and regulations (e.g., Title VII, ADA, FMLA, FLSA, FEHA, PAGA) and federal and state agencies (e.g., DOL, EEOC, DLSE, DFEH). Privacy counseling and advice experience a plus.
  • Experience with single plaintiff litigation matters. Experience with class/representative/collective actions a plus!
  • Entrepreneurial mindset that enables you to work independently while using good judgment to escalate issues when needed.

The good faith estimated range of base salary pay for the above position for California-based candidates is $145,000-185,000 depending on factors including but not limited to experience and skill. There is a target discretionary incentive bonus of 20%.
